HVAC Trust Terms & Conditions
Terms & Conditions In these terms and conditions "the Owner" shall mean the person, firm, company or authority whose order has been accepted by the Company and "the works" shall mean the works to be carried out pursuant to an order by HVAC Trust.
ALL QUOTATIONS / ESTIMATES MADE AND ORDERS ACCEPTED BY THE COMPANY are SUBJECT TO THESE TERMS AND CONDITIONS.
- Any provision stipulation or condition which conflicts with or in any way qualifies or negates any of these terms and conditions shall have no effect and these terms and conditions shall prevail.
- No variation of these terms and conditions shall be valid unless evidenced in writing under the signature of a director of the Company.
- If any given completion date is delayed for any reason beyond the Company's control (Including but not limited to inclement weather, accidents, loss or damage of any kind, strikes, cessation of labour affecting any trade engaged upon the works or the inability of the Company to secure labour and / or materials) a fair and reasonable extension of time for completing the works shall be granted to the Company.
- Owner will provide space at the job site to permit the contractor to store all materials.
On Full Payment With Credit cards, Transaction fee will be 3% Charged Automatically.
I (the “buyer”) agree with the above project and I agree to make payment upon agreed time frame of payment structure. I agree that HVAC Trust retains title to "the works". HVAC Trust retains title to equipment/material furnished until final payment is made. If payment is not made as agreed, the Seller can remove the equipment/material subject to this agreement, and/or pursue additional redress, including but not limited to the placement of liens at the Buyer's expense.
The Buyer is responsible for any legal fees and costs incurred by the Seller in the performance of this agreement as well as legal fees incurred because of payment not received by the seller.
Any damage resulting from removal shall be the responsibility of the Buyer.
Payment in full shall be made on the day of completion of the works.
Any unpaid amounts shall accrue interest at an annual percentage rate of 34.489% until paid in full.
LIMITED WARRANTY: All materials, Parts, and Equipment are warranted by the manufacturer’s warranty only. All labour performed by the Seller is warrantied according to specifications on the agreement or invoice. Labour warranties are void if the unit is worked on by another party other than HVAC Trust. HVAC Trust agents or technicians are not authorized to make any warranties on behalf of the above-named company other than those contained in the agreement. Any future issues involving service calls that are not related to the equipment installed on this invoice may have Service Fees that follow. All manufacturer warranty registrations should be applied by the buyer.
You agree to pay for NSF checks and other returned items at the rate of $50.00 dollars plus actual bank charges incurred plus any other amounts allowable by law.
All Deposit are Non-Refundable
